PINNACLE OS — CLIENT TERMS AGREEMENT Please read carefully before completing your payment
1. Parties
This Agreement is between Pinnacle OS, a division of Pinnacle Media Inc. ("we," "us," or "our") and the individual or business completing payment ("you," "your," or "Client").
By checking the agreement box and completing payment you confirm that you have read, understood, and agree to all terms outlined in this Agreement.
2. Services Included
Your subscription includes the services outlined in the plan you selected at the time of purchase:
Launch — $99/month Free custom website, website hosting, search engine visibility, up to 2 users, email support. Website updates are self-managed — no team support included.
Growth — $299/month Everything in Launch plus monthly website maintenance, up to 5 users, unlimited CRM contacts, mobile app access, website chat assistant, automated SMS and email follow-up, Google review automations, reputation management, pipeline management, social media scheduler, and priority email support.
Premium — $499/month Everything in Growth plus unlimited users, auto DM, Facebook and Instagram lead automation, email remarketing, database reactivation, customer newsletter email sequence, customer referral email sequence, sales distribution automations, and white-glove onboarding.
3. Billing and Payment
Your subscription is billed monthly on a recurring basis starting on the date of your first payment.
Your billing date is set automatically on the date you complete your first payment and recurs on the same date each month.
All fees are charged in Canadian dollars unless otherwise stated.
Usage fees for SMS, email, and call services are billed separately based on actual usage and are in addition to your monthly plan fee. For every $1.00 USD of usage you receive approximately 1,500 emails, 67 text messages, or 100 minutes of calling. A dedicated phone number is an additional $1.15 USD per month.
4. No Refund Policy
All payments made to Pinnacle OS are non-refundable.
No refunds will be issued for any reason including but not limited to: Cancellation before the end of a billing period Dissatisfaction with the service Non-use of the platform or any of its features Changes in your business circumstances
By completing payment you acknowledge and accept that all fees are final and non-refundable.
5. Chargeback Prohibition
You agree not to initiate a chargeback or payment dispute with your bank or credit card provider for any charges made in accordance with this Agreement.
If you have a billing concern or dispute you agree to contact us directly at [email protected] before initiating any dispute with your financial institution.
Initiating a chargeback without first contacting Pinnacle OS will be considered a material breach of this Agreement and may result in: Immediate account suspension or termination Referral to a collections agency Legal action to recover the disputed amount and any associated costs
6. Cancellation Policy
You may cancel your subscription at any time by providing written notice to [email protected].
Cancellation takes effect at the end of your current billing period. You will retain access to the platform until the end of the period you have already paid for.
No prorated refunds will be issued for unused portions of a billing period.
Upon cancellation your sub-account, website, automations, and all associated data will be deactivated. You are responsible for exporting any data you wish to retain before your cancellation date.
7. Website Revisions
Your plan includes one round of website revisions at setup. A maximum of 2 (two) revision rounds total are included across the life of your onboarding period.
Revision requests beyond the included rounds are billed at $100 per hour and must be submitted via our support email at [email protected].
A revision is defined as minor copy, image, or layout adjustments to existing sections. New pages, structural redesigns, or additional integrations are considered separate projects and will be quoted separately.
8. Usage Fees and Third Party Costs
Your monthly plan fee does not include usage fees for SMS, email, calling, or phone number rental. These are billed directly based on your actual usage.
You are responsible for adding and maintaining valid payment information for usage fee billing. Pinnacle OS is not responsible for service interruptions caused by failed usage fee payments.
9. Platform Dependency
Pinnacle OS services are powered by GoHighLevel, Google, Meta, and other third-party platforms. Pinnacle OS is not responsible for any service interruptions, feature changes, policy changes, or downtime caused by these third-party platforms.
In the event that a third-party platform changes its pricing, features, or availability, Pinnacle OS reserves the right to adjust its services or pricing accordingly with 30 days written notice to the client.
10. No Guarantee of Results
Pinnacle OS does not guarantee specific business results including but not limited to: Search engine rankings or Google visibility Lead volume or quality Revenue growth Review count or rating improvements. Ad performance or conversion rates
Results vary by business, market, and effort. Pinnacle OS provides the tools and infrastructure — results depend on factors outside our control.
11. Confidentiality
Pinnacle OS will not sell, share, or disclose your business information or client data to any third party except as required to deliver the services outlined in this Agreement or as required by law.
12. Intellectual Property
All website templates, automation workflows, SOPs, and system architectures built by Pinnacle OS remain the intellectual property of Pinnacle OS during the term of this Agreement.
Upon cancellation you retain ownership of your business content including copy, images, and branding. Platform infrastructure including templates and automations remain the property of Pinnacle OS.
13. Governing Law
This Agreement is governed by the laws of the Province of Alberta, Canada and the federal laws of Canada applicable therein. Any disputes arising under this Agreement shall be resolved exclusively in the courts located in Calgary, Alberta.
14. Entire Agreement
This Agreement constitutes the entire understanding between Pinnacle OS and the Client with respect to the services described herein and supersedes all prior discussions, representations, or agreements whether written or oral.
